Is the Federal Government Going after States Sheriffs?

Effort to abolish local sheriffs a stealth federal power grab?

The mainstream media has not reported the story, but the son of Vice President Joe Biden, who serves as Attorney General for the state of Delaware, has issued a mandate to county commissioners informing them that sheriffs in the state’s three counties no longer have arrest powers.

Slowly but surely, the people who have seized control of out nation are closing the gates on what remains of our liberty. I have no doubt this story is in reaction to the many Sheriffs in this country who have openly stated they would refuse to implement unconstitutional laws enacted by the federal government. If this is the case, what you have here is yet another modern example of the same exact complaints the founders listed against the Crown of England when they penned the Declaration of Independence.

I’m telling you — and I say this with certainty — there is no way to save the whole of this nation. The Leftist parts of it are too far gone. the only hope that remains is for those States where the majority of the people still understand and embrace the founding principles and ideals of this nation to secede from this union, band together and defend themselves from the inevitable death-struggle that will follow when the rats in these Leftist States realize that — without us — they will starve. I’ve studied history, and I don’t see another way around the situation we’re facing. If we continue on this path, the decay that is the American Left will kill the entirety of this nation. Just look to history and you’ll find the proof. So, as difficult as it is for those of us who love what we once were, we’re simply going to have to accept that we need to amputate a couple limbs if we’re going to save what’s left. It’s just that simple.

  1. How is it even POSSIBLE to strip Locally elected LEO of power……..What I’m saying is that this doesn’t even seem Legal.
    The assumption is that the ONLY authority is a Centralized one !!!….. Next they can say your school district isn’t legal….your Local Judges aren’t legal….etc etc

    One sign of this was when Texas threatented to throw out the TSA … and the Obama Admin threatened to fly F-16s and make Texas a No-fly zone…..remember….the reprecussions of Perry / Dewhurst NOT standing FIRM….we see in Biden’s (Obama’s) Delaware Politburo Central Committee Directive.

    I think Joe is Correct ………. Time to re-invigorate the 4th. 9th and 10th amendments !

      I catch a LOT of flak for pointing this out, but “legal” doesn’t mean anything in this country anymore. the rule of law ended some time ago (at least as far back as Bill Clinton).

          Just one thing. Part of that de Tocqueville quote: well, there is some question as to whether or not he actually said the part about American being great because it is good. The best source traces that back to a recounting of a U.S. President who claimed to have heard Alexis say it.

          Sorry, just thought I’d mention it — just in case. But the other quotes are his, and they pretty much mean the same thing, so… 🙂

              I only offered it as a possibility because, having read de Tocqueville, I could see him as having actually said this. It is possible that the assertion he didn’t is a result of Leftist revisionism. Either way, I can’t find where he wrote it down, so I figured I would mention the caveat 😉

    What a piece o work this jerkasures is that I’m dealing with. He’s gettin upset that I called him silly boy? Reckon I shoulda called him sissy boy! So then he says to me how he’s 76, and I don’t know what the hello I’m talkin about. That was funny. Really funny. Tomorrow the silly sissy 76-year-old boy who wants gun control gets spanked……..primarily from the silly boys here.Yeah, baby. I’m all about corporal punishment. Hey, he dissed my crush, Kevin Tully.       Remind your friend that one of the problems with our society today is that the “me-me-me” generation we call “baby-boomers” may be up in years, but they never grew up. they are still stuck in diapers and looking to suckle at their mother’s tit. Problem is, mommy died long ago and the only thing they have left is the govt. So take his assertion that age=wisdom with a box of salt — especially when he’s asserting self-evident falsehoods.

      As for the rest, you have free reign to post whatever you’d like here and you know it 😉

      The government has been doing things that are NOT legal for a long time, and we have let them get away with it. Obama is not — repeat — NOT a “natural born citizen,” yet he is President. This is not a “birther” thing, it is a legal definition thing and it is on the law books (ask Texas to explain it). So, if we will let the President break the Constitution, why should something like this bother anyone? 😦

  3. DOVER, Del. – Delaware lawmakers are considering legislation to clarify the arrest authority of county sheriffs.
    A bill sponsored by Rep. Danny Short, R-Seaford, and Sen. Gary Simpson, R-Milford, would modify state law to explicitly prohibit sheriffs and deputies from making arrests. The proposal has bipartisan support.
    “It tells the sheriffs of the state of Delaware what they can and cannot do,” said Short. “Specifically, it says they cannot arrest people.”
    The bill is partially intended to resolve an ongoing dispute between Sussex County Sheriff Jeff Christopher and the county administration.
    Delaware sheriffs traditionally conduct foreclosure sales and deliver court papers. Christopher believes the state constitution makes him a law enforcement officer. The county council and county administration disagree. Last fall, then-County Administrator David Baker ordered deputies to stop performing police work and remove lights from sheriff’s vehicles. Baker said the sheriff was putting the county at risk of lawsuits. Source WBOC

    Really a strange situation. A bill sponsored by two Republicans would explicitly prohibit these three sheriffs from making arrests and has bipartisan support. From what I can find, Sussex County Sheriff (as well as the other two Delaware county sheriffs) Jeff Christopher never actually had powers of arrest. Christopher seems to believe he did. This artlcle also stated Delaware is the only state where county sheriffs have no powers of arrest.

    The first Constitution of Delaware in 1776 made the sheriff a conservator of the peace within the county in which they reside, New Castle, Kent, and Sussex . The sheriff was, and still is, chosen by the citizens of each county at the general elections to serve a four-year term. Per Title 10, Chapter 21 of the Delaware Code, the Sheriff is an officer of the court. Responsibilities include processing orders of the court system; summoning inquests, jurors, and witnesses for the courts; and, conducting execution sales against personal and real estate property. County Sheriffs and their regular appointed deputies also take into custody unincarcerated persons immediately upon conviction of an imprisonable offense and convey them to the appropriate correctional facility to serve their terms. The County Sheriffs and their deputies do not engage in typical law enforcement, their primary role is to provide enforcement services for the courts. Typical law enforcement, such as the enforcement of motor vehicle laws, investigation of crimes and routine policing patrols are performed by State, County and municipal (Town or City) police forces.[4]
