The Collapse of “Rule of Law” Accelerates

When a society abandons the rule of law and protection of the rights of the minority and/or accused, then that society has started down the path toward tyranny. It is a walking corpse that just hasn’t realized its life (i.e. liberty) has ended. We live in such a society today and this story shows how and why:

Man Screamed at Fort Lauderdale Children Who Were in “Heightened State of Fear” After Newtown Shooting: Judge

A Broward judge ordered David Burch held without bond Thursday, saying he believed the 28-year-old man “intentionally terrorized” children at a Fort Lauderdale elementary school when he screamed and waved his arms at them.

Now, understand, I do not disagree with taking reasonable precautions, but that is not what this story is actually about. Note hoe the judge based his decision on his personal bias:

he believed the 28-year-old man “intentionally terrorized” children at a Fort Lauderdale elementary school when he screamed and waved his arms at them.

Had the judge said he was denying bail based on his determination that there was just cause to believe this man presented a real and on-going threat to the community, then I would have supported him. But the judge did not do this. Instead, the judge invoked “boogeyman’ and emotional language (i.e. terrorism and children) in the certain knowledge that this would “excuse” his trampling of this man’s individual and constitutional rights.

You see, the way he worded it, the judge reacted by convicting this man without full knowledge of the facts. He violated the process that is written into our constitution to prevent precisely this sort of thing from happening to us. But the outrage will no doubt be directed toward the man who was arrested and not toward the judge who has furthered the institutionalization of the rule of men over the rule of law.

And one more piece of rotting flesh falls from the walking corpse that was once a free and self-governing land…
